HMRC enforcement visits: what to do

An HMRC enforcement visit is a serious escalation. Whether it is a field force officer making first contact or certified enforcement agents attending to take control of goods, this is not a situation to manage alone. Call us immediately. We can intervene with HMRC’s Enforcement team the same day to halt proceedings while we negotiate a structured resolution.

The Difference Between a Field Force Visit and Bailiff Action

Directors often confuse the two, and the distinction matters.
Field force officers are HMRC employees or contractors who visit your business premises to make face to face contact, discuss the debt, and prompt voluntary payment or arrangement. They cannot force entry, seize goods, or take any physical enforcement action on their own authority. A field force visit is designed to prompt action, but it is also a warning that you are close to the next stage.

Certified enforcement agents, informally called bailiffs, operate under a Taking Control of Goods notice. This is a separate legal instrument. At this stage, agents have authority to enter your commercial premises, list goods and assets, and if payment or arrangement is not made, remove and sell those assets.

HMRC does not need a court order to reach this stage. It has unique statutory powers that bypass the court process entirely.

HMRC deploys field force officers across the UK every day, visiting businesses in arrears that have not engaged. If you have received a visit or a Notice of Enforcement, the clock is running.

What HMRC Can Take

Under the Taking Control of Goods process, certified enforcement agents can take control of and sell business assets to recover the debt. This includes:

  • Stock and inventory
  • Office equipment, machinery, and vehicles
  • Business furniture and fixtures

Certain assets are exempt, including tools needed to carry out your trade up to a value limit, equipment on hire purchase, and goods not belonging to the business. Proving third party ownership at the point of visit requires documentation, and most directors are not prepared for that on the day.

Assets cannot be removed from your home without a separate court order, and visits to premises that are part residential have additional restrictions on timing and conduct.

Support When Officers Are at the Door

An HMRC enforcement visit rarely lands at a convenient moment, and the hours immediately after a field force officer or enforcement agent attends are the ones that matter most. That is why our expert team is available whenever you need us, including weekends and Bank Holidays.

At TaxDebts, our priority is to give you total peace of mind that your situation is being handled by somebody who cares, so you can focus on keeping the business running while we deal with HMRC.

HMRC’s Enforcement Escalation Sequence

Understanding where you are in HMRC’s process shows how much time you have.

  1. Payment demand letters: written contact asking for payment within 7 days
  2. Debt management phone contact: HMRC calling before escalating
  3. Field force visit: face to face contact, no powers to seize
  4. Notice of Enforcement: formal notice that certified agents will attend
  5. Enforcement agent visit: agents list and take control of goods

Winding-up petition: HMRC petitions the court to close your company

An enforcement visit typically means you are at stage three or four. The window to resolve this without asset seizure or winding-up action is still open, but it is closing.

What to Do if Enforcement Officers Attend Your Premises

  • Ask to see their identification and authority to attend
  • Do not obstruct or physically prevent entry to commercial premises, as this can constitute a criminal offence
  • Do not remove or conceal assets already subject to a Taking Control of Goods notice, as this is also a criminal offence
  • Take the officer’s name, agency name, and reference number
  • Call us immediately so we can speak with HMRC’s Enforcement team the same day

The most common mistake directors make is trying to negotiate directly with the enforcement agent on the doorstep. The agent has limited discretion. The negotiation that matters happens above them, at HMRC’s Debt Management level.

How We Stop Enforcement Action

How to Stop a Winding Up Petition

We contact HMRC’s Debt Management or Enforcement and Insolvency team immediately, signal that professional advisors are involved, and request a stay of enforcement while we prepare a structured proposal. In most cases this pauses enforcement action while we negotiate.

We then assess the full debt position, identify whether a Time to Pay arrangement is achievable, and where necessary advise on formal insolvency options that carry a statutory moratorium halting all creditor action including HMRC enforcement.
